Privacy Policy

1. Scope
This Privacy Policy describes how Janover Capital LLC ("Janover Capital," "we," "us," or "our") collects, uses, shares, and protects information in connection with janover.co (the "Site") and the services we offer through it. It applies to the Site only; affiliated Janover businesses and third-party websites linked from the Site maintain their own privacy practices. By using the Site, you agree to this Policy and to our Terms of Use.
2. Information we collect
Information you provide. When you request financing, contact us, or otherwise submit information, we collect what you choose to provide, which may include: name; company or entity name; email address; phone number; property and deal information (property type, location, loan amount, purpose, timeline, financials such as rent rolls, operating statements, and net operating income); and any other information you include in messages or documents.
Information collected automatically. When you use the Site, we and our service providers may automatically collect standard technical data, such as IP address, approximate location derived from IP, device and browser type, operating system, referring pages, pages viewed, and interaction data, including through cookies or similar technologies and website analytics if enabled.
Information from other sources. In the course of evaluating or arranging financing, we may receive information about you or your transaction from third parties, such as public records, commercially available databases, referral partners, lenders, and transaction parties (for example, appraisers or title companies).
3. How we use information
We use information to: evaluate, size, and arrange financing you request; communicate with you about your inquiry, transactions, and our services, including by phone, text, and email as described in Section 5; operate, maintain, secure, and improve the Site; perform analytics and measure Site performance; develop and improve our services; comply with law, regulation, and legal process; enforce our Terms of Use and other agreements; detect, investigate, and prevent fraud, abuse, and security incidents; and protect the rights, property, and safety of Janover Capital, our clients, and others. We may also use aggregated or de-identified information, which does not identify you, for any lawful purpose.
4. How we share information
We do not sell your personal information, and we do not share it with third parties for cross-context behavioral advertising. We share information as follows:
- Prospective lenders and transaction parties. With your direction or consent, we share deal and contact information with prospective lenders and parties needed to evaluate or close your financing (for example, appraisers, title companies, environmental consultants, and counsel).
- Affiliates. With affiliated Janover businesses for the purposes described in this Policy, consistent with this Policy.
- Service providers. With vendors that perform services for us (for example, website hosting, form processing, communications, analytics, and data storage), under obligations appropriate to the service.
- Professional advisors. With our lawyers, accountants, insurers, and similar advisors as reasonably needed.
- Legal and safety. When we believe disclosure is required or appropriate to comply with law, regulation, subpoena, or legal process; to enforce our agreements; or to protect the rights, property, or safety of Janover Capital, our clients, or others.
- Business transfers. In connection with any merger, acquisition, financing, reorganization, or sale of all or part of our business or assets, in which case information may be transferred as a business asset.
5. Communications and your choices
If you provide contact information, we may contact you by phone, text message, and email about your inquiry and our services, as described in the Terms of Use. Consent to marketing communications is not a condition of any service. You may opt out of text messages by replying "STOP," opt out of marketing emails via the unsubscribe link, or contact us at (561) 559-4111 or desk@janover.co to update your preferences. We may still send you non-promotional communications related to an active inquiry or transaction.
6. Cookies and analytics
The Site uses only the technologies needed to operate and, if enabled, privacy-conscious analytics to understand aggregate usage. Your browser settings can limit or block cookies; the Site will continue to function. The Site does not currently respond to "Do Not Track" browser signals. Where required by applicable law, we honor opt-out preference signals such as Global Privacy Control for covered sharing; as noted above, we do not sell personal information or share it for cross-context behavioral advertising.
7. Data retention
We retain information for as long as reasonably necessary for the purposes described in this Policy, including maintaining transaction records, complying with legal, tax, accounting, and regulatory requirements, resolving disputes, and enforcing agreements. Retention periods vary by information type and context. When information is no longer needed, we take reasonable steps to delete or de-identify it.
8. Security
We use commercially reasonable administrative, technical, and physical safeguards designed to protect information. No method of transmission or storage is completely secure, and we cannot guarantee absolute security. Please do not submit sensitive personal information (such as Social Security numbers or account credentials) through the Site's forms; if a transaction requires sensitive documents, we will arrange an appropriate channel.
9. Your privacy rights
Depending on your state of residence, you may have rights under applicable privacy laws, such as the right to know or access the personal information we hold about you, correct it, delete it, obtain a portable copy, or opt out of certain processing. Much of the information we handle relates to commercial transactions and may be exempt from certain state privacy laws; we honor valid requests as required by applicable law. We may need to verify your identity before responding, and we will not discriminate against you for exercising your rights. Authorized agents may submit requests with proof of authorization.
10. Children
The Site is a commercial finance site directed at adults. It is not directed to, and we do not knowingly collect personal information from, anyone under 18. If you believe a minor has provided personal information through the Site, contact us and we will delete it.
11. Users outside the United States
The Site is operated from and intended for users in the United States. If you access it from elsewhere, you understand that your information will be transferred to, stored in, and processed in the United States, where privacy laws may differ from those of your jurisdiction.
12. Third-party links
The Site links to other websites, including affiliated Janover businesses (Janover Pro, Multifamily.loans, and CommercialRealEstate.loans). This Policy does not apply to those sites, and we are not responsible for their privacy practices. Review their policies directly.
13. Changes to this policy
We may update this Policy from time to time. The revised version will be posted here with an updated effective date, and material changes may be highlighted on the Site. Your continued use of the Site after posting constitutes acceptance.
